Madrid Protocol in India, July 08, 2013
India has put into effect The Madrid Protocol on July 08, 2013 and consequently amended the Trade Marks Act, 1999 and rules made thereunder. Highlights are as below:
1. As on July 08, 2013 India puts into effect the Madrid Protocol – so now international filing now simplified
India acceded to the Madrid Protocol earlier this year and made the same effective beginning July 8, 2013, thereby simplifying the international procedure for the registration of a trade mark.
2. An existing applicant or registered proprietor may now make an online application for the registration of their trade mark under the Madrid Protocol
A natural person or a legal entity having real and effective industrial or commercial establishment in, or is domiciled in, or is a national of India and has got a registration of trade mark or has an application pending for the registration of trade mark in India may make an online application for the registration of their trade mark under the Madrid Protocol.
3. Single application, single fee for 90 countries
International registration in as many as 89 member countries to the Protocol, apart from India through a single application may be obtained by simply filing a single application with the International Bureau of the WIPO, in English, and on payment of single set of fees.
